FinTech: Law and Regulation

Module Objective: To provide you with an in-depth understanding of the legal and regulatory issues and challenges arising from the increased use of technological innovations in financial services (FinTech).



Module Content: The course addresses: the contemporary digitalisation of financial services; the examples of technological advances in recent years (ranging from cryptocurrencies to blockchain to smart contracts as well as the parallel trends in AI, Big Data analytics and cloud computing); the expansion of these technological developments to other areas of commercial practice; the effects of 'disruptive innovation' for the banking sector; the applicable law and the resulting regulatory gaps; and the approaches which have been adopted in various jurisdictions to regulate the progress of FinTech.



Learning Outcomes: On successful completion of this module, you should be able to:

  • Identify the relevant legal and regulatory issues and challenges arising from FinTech;
  • Recognise the development and the purposes of the underlying technologies associated with FinTech;
  • Describe and critically analyse the options for appropriately regulating for the growth of FinTech;
  • Conduct masters-level research on aspects of FinTech law and regulation;
  • Apply their knowledge of the law to the set assessment.
